El libro “El presente de la filosofía del derecho” de Milagros Otero Parga, catedrática de la Universidad de Santiago de Compostela, es una de las principales novedades bibliográficas del año en el ámbito jurídico. El título da cuenta del carácter comprehensivo de su contenido, pues el ensayo realiza un recorrido por el pasado y el presente de la filosofía del derecho en toda su amplitud. Se abordan las nociones de “pueblo” y de “populismo” desarrolladas por Laclau y se presenta la crítica de Zizek a la noción de “pueblo”, desde su defensa de la categoría de “clase social”. Posteriormente se exponen los vínculos entre la teoría queer de Butler, la ciudadanía democrática radical de Mouffe y el populismo de Laclau y se presentan las críticas feministas dirigidas contra el desplazamiento de la categoría “mujeres” efectuado por dichas filosofías. Finalmente se abordan, desde la obra de Millett, (...) MacKinnon y Firestone, las discrepancias entre el marxismo y el feminismo entorno al antagonismo principal de la sociedad (clase social/clase sexual). Así el trabajo aborda las tensiones y desplazamientos entre las categorías “pueblo”, “clase social” y “clase sexual” y la capacidad de cada una de ellas para desencadenar la transformación de la sociedad. Current frameworks on ethical decision-making process have some limitations. This paper argues that the consideration of moral competencies, understood as moral virtues in the workplace, can enhance our understanding of why moral character contributes to ethical decision-making. After discussing the universal nature of four moral competencies (prudence, justice, fortitude and temperance), we analyse their influence on the various stages of the ethical decision-making process. We conclude by considering the managerial implications of our findings and proposing further research.

Urban Digital Twins (UDTs) have become the new buzzword for researchers, planners, policymakers, and industry experts when it comes to designing, planning, and managing sustainable and efficient cities. It encapsulates the last iteration of the technocratic and ultra-efficient, post-modernist vision of smart cities. However, while more applications branded as UDTs appear around the world, its conceptualization remains ambiguous. Beyond being technically prescriptive about what UDTs are, this article focuses on their aspects of interaction and operationalization in connection to people in (...) cities, and how enhanced by metaverse ideas they can deepen societal divides by offering divergent urban experiences based on different stakeholder preferences. Therefore, firstly this article repositions the term UDTs by comparing existing concrete and located applications that have a focus on interaction and participation, including some that may be closer to the concept of UDT than is commonly assumed. Based on the components found separately in the different studied cases, it is possible to hypothesize about possible future, more advanced realizations of UDTs. This enables us to contrast their positive and negative societal impacts. While the development of new immersive interactive digital worlds can improve planning using collective knowledge for more inclusive and diverse cities, they pose significant risks not only the common ones regarding privacy, transparency, or fairness, but also social fragmentation based on urban digital multiplicities. The potential benefits and challenges of integrating this multiplicity of UDTs into participatory urban governance emphasize the need for human-centric approaches to promote socio-technical frameworks able to mitigate risks as social division. La entrada de divisas ligada a la afluencia de veraneantes se tradujo en un impulso considerable al proceso de modernización del país. Al mismo tiempo, el encuentro personal directo entre turistas y residentes facilitó el acceso de la población española educada bajo el franquismo a las pautas de actuación social, moral y cultural de (...) los países de su entorno geográfico. Este artículo analiza la contribución del turismo a la inserción de España en la órbita de los países capitalistas y democráticos del mundo occidental, al servir de factor legitimador del sistema político, embajador de una imagen nacional y acelerador del crecimiento económico, el cambio sociológico y la integración institucional del país. Academic entrepreneurship and the formation of spin-offs from educational institutions have been consolidated as essential elements to promote innovation and stimulate economic growth worldwide. However, the evolution of these initiatives shows marked differences between developed countries and emerging economies, such as Colombia. This study focuses on analyzing how research in this area has progressed, identifying the key factors that determine the success of spin-offs and suggesting a framework for action for Colombia in comparison with international dynamics. The findings reveal a (...) shift in research attention from prioritizing the creation of spin-offs to a greater focus on their long-term performance and sustainability. At the international level, the relevance of technology transfer, strategic alliances between universities and industry and the efficient management of technological resources are highlighted. On the other hand, in the Colombian context, research tends to focus on institutional aspects, cultural factors and support regulations, underestimating the analysis of the performance of spin-offs after their creation. This paper aims to contribute to the formulation of policies and strategies that promote not only the emergence but also the sustainability of academic spin-offs in Colombia, seeking to align their practices with international standards in order to maximize their impact on the economic and social development of the country. Introduction Currently, The nature and scope of Clinical Ethics Protocols in Madrid are not well understood.Objectives The main objective is to describe the features of ‘guideline/recommendation’ type CEPs that have been or are being developed by existing Clinical Ethics Committees in Madrid. Secondary objectives include characterisation of those CECs that have been the most prolific in reference to CEP creation and implementation and identification of any trends in future CEP development.Methods We collected CEPs produced and in process by CECs accredited (...) in the public hospitals in Madrid, Spain, from 1996 to 2008.Results CECs developed 30 CEPs, with 10 more in process. The most common topic is refusal of treatment . If CEPs addressing terminal illness, Do-Not-Resuscitate orders and advance directives are placed into a separate ‘ethical problems at the end of life’ category, this CEP subject emerges as the most common . There is a relationship between the age of the CEC and the development of CEPs . CECs now seem to be more likely to engage in CEP development.Conclusions The CECs in Madrid, Spain, have developed a significant number of CEPs and there is a trend towards continued development. The most frequent topics are ethical problems at the end of life and refusal of treatment by the patient. (shrink)

From the moment in which all body is hidden, and the grave is empty of all presence, has a fundamental lack in common. Therefore this lack, in regard to the Christian world, is expressed in terms of original concealment. For its part, the medieval theological and mystical tradition, heiress and interlocutor of a metaphysical tradition of the Hellenic world, systematized throughout the centuries the grammar of this disappearance in terms of an inaccessibility and irreducibility of being, namely, an essential of (...) the Logos negativity. One could anticipate, therefore, as arrival point, than the language of the Christian mystical tradition, is not only the language of the lack of a body, but also the search for one language enough to reconcile the universal with the autonomous unit of the language. This article proposes, therefore, rebuild the way in that historian and Jesuit theologian, Michel de Certeau, genealogically rebuilt part of a mystical tradition that, immersed in a series of variables and potential historical of enunciation, is expressed in terms of “a place without place”, originally missing whose, would lead to a relationship of alterity. This would be one of the outcomes in early Western modernity of what from the origins of Neoplatonism known as the solitude of the one, either, the absence of God. (shrink)

Given the reality of legal orders collapsing or breaking, this paper argues that a good explanation is needed to understand this phenomenon. It adopts a Hartian account of positivism and considers law as part of a larger set of social facts and orders. The paper analyzes the relationship between evil moral commitments and the law. It concludes by showing that it might be more conducive to analyzing the loss of faith in a legal system as an explanation for its collapse (...) rather than thinking about problematic commitments to evil moral attitudes. This paper argues for a broad definition of philosophical sources and how Indigenous traditional knowledge fits that definition. It concludes by showing how, following the previous two points, an Indigenous document such as the Huarochirí Manuscript can be considered a philosophical source by academic philosophers. The paper has three sections: the first deals with the methodological point of addressing what can be considered as philosophy. This section presents a conversational approach to philosophy. This approach, although broad, properly captures the practices (...) of inquiring about philosophical issues as is commonly done in Western academic circles, but without excluding the practices of non-Western cultures from being labelled as philosophical. The second section argues for the analytical distinction between a philosophical source, a philosophical text, and a philosophical insight. It shows that what makes a philosophical source such are the philosophical insights that it can provide. The final section shows how the Huarochirí Manuscript has merits making it worthy of being considered a philosophical source and thus a relevant academic source for those working in the field of philosophy. Charles Peirce is widely credited as the originator of semiotics, or the general theory of signs, and recognized as the founder of American pragmatism, albeit in that peculiar kind Peirce himself went on to distinguish as “pragmaticism.” The semiotic and pragmatist strands in Peirce’s thought come together in an appraisal of scientific diagrammatic representations. Peirce’s pragmatic maxim entails that the consequences of a sign inform our entire conception of the sign, while his most considered semiotic system entails that a complex (...) sign partakes of iconic, indexical, and symbolic aspects. We illustrate Peirce’s insights by means of the celebrated Feynman Diagrams in Quantum Electrodynamics. We argue that Peirce’s late, post-1903, semiotics provides an adequate characterization of such “hypoicons,” and his pragmatic maxim explains how they can motivate and drive inquiry. We conclude that Peirce’s pragmatic approach to scientific diagrams remains a viable position that skillfully avoids dogmatic scientism and nihilistic skepticism alike. (shrink)

I introduce a novel multidimensional framework tailored to investigate a set of phenomena that might appear intractable and render them amenable to scientific inquiry. In particular, I focus on examining altered states of consciousness that appear to the experiencing subject as “contentless” or “objectless” states in some form, either by having disrupted or reduced content of awareness, or content that appears as missing altogether. By drawing on empirical research, I propose a cluster of phenomenological dimensions aimed at enhancing our understanding (...) of this group of experiences of minimal awareness, including Richness of the Content, Bodily-Awareness, Passage of Time, Attentional Focus, and Self-Revelation. The result is a robust framework that provides precise scientific terminology, facilitating its operationalisation and adaptability for future empirical work. I show the explanatory power of this framework through a case study of the state of clear light sleep—a state widely reported by Indo-Tibetan Buddhist traditions as an instance of pure awareness during sleep, a state of consciousness-as-such. This rare phenomenon has gained increasing attention in contemporary analytic philosophy of mind for the study of the nature of consciousness. However, we still lack consensus on its characterisation and potential identity with other associated states. I end the paper by illustrating how the state of clear light sleep can be situated in relation to other associated states and more ordinary ones as regions of a multidimensional state space. Este artículo explora las formas en que la migración afecta al sentimiento de pertenencia del migrante al grupo nacional-cultural a partir de un ensayo autobiográfico del escritor heleno-sueco Theodor Kallifatides. El estudio se basa en los análisis del sentimiento de pertenencia al grupo procedentes de la fenomenología contemporánea. Pese a su gran interés, dichos estudios se fijan o bien en episodios afectivos demasiado circunscritos en el tiempo, o bien en orientaciones afectivas de fondo con contornos demasiado vagos para capturar la (...) especificidad del fenómeno que nos interesa. Apoyándose en el texto de Kallifatides, el artículo esboza algunos elementos específicos del sentimiento de pertenencia que se reconfiguran en la migración, apuntando a los papeles que juegan el reconocimiento y la identidad narrativa, y subrayando los matices, gradaciones y la maleabilidad de dicho sentimiento. The hypothesis that terrorism often emerges when mass collective action declines and radicals take up arms to compensate for the weakness of a mass movement has been around for some time; however, it has never been tested systematically. In this article the authors investigate the relationship between terrorist violence and mass protest in the context of the Spanish transition to democracy. This period is known for its pacts and negotiations between political elites, but in fact, it was accompanied by high (...) levels of terrorist violence and popular mobilization. To test the hypothesis, the authors have created two data sets, one on victims of terrorism and another on participation in demonstrations. The data clearly confirm that terrorism erupted in Spain when participation in demonstrations started to decline. This result sheds new light on the nonstructural conditions associated with the onset of terrorist violence. (shrink)

Wil Waluchow’s notion of Community’s Constitutional Morality (CCM) was developed as a tool for the identification of moral norms and considered judgments that are in some way tied to a community’s constitutional law and practices. In this paper I first argue that even though the tool was conceived under a state-based paradigm, it also works on a global scale. Then, I show how by relying on this tool we can achieve two important and clearly differentiable goals. The first goal relates (...) to efforts regarding the construction of global theories of justice. By using Waluchow’s CCM we can overcome what I call the problem of adjudication among differentexisting moral intuitions. That is, the need to choose between different and competing fundamental moral commitments that ought to guide our moral deliberations. Instead, by using CCM, we can identify Embodied Moral Intuitions that hold an epistemic advantage over Personal Moral Intuitions, which are commonly used to ground normative projects. The second goal relates to contemporary efforts to decolonize our perspectives about justice, domestic and global. By relying on Waluchow’s notion of CCM, the reality that Indigenous knowledge, despite it not having been properly acknowledged in most philosophical academic debates, is already a part of our debates about global justice becomes undeniable and a call for action to further expand our understanding of global political morality. Objective: to determine the relationship between personal management and financial anxiety during COVID-19 times among residents of Northern Peru. Financial mismanagement, as a result of disorder in management and financial anxiety, leads to economic difficulties that can deteriorate citizens' health. Methodology: the approach was quantitative, of a basic type, at a descriptive correlational level, and included a sample of 360 residents from Northern Peru. Results: According to Spearman's Rho correlation, there is a negative correlation (r = -0.119) with a significance (...) of 0.024, which is less than 0.05. This indicates inadequate personal management knowledge that generated financial anxiety among the inhabitants of Northern Peru, due to the economic situation caused by the COVID-19 pandemic. Contribution: about health emergency, the risk and the possibility of knowledge in personal, social management warrants understanding the human person from various perspectives: economic, social, educational, legal, and political in a highly complex world. In conclusion, this paper explores the intricate dynamics of improper omission as an amplifying device within the Colombian legal context. A detailed analysis has demonstrated how improper omission allows the imputation and punishment of individuals who, without fulfilling the typical description of conduct, incur criminal liability when they abandon their role as guarantors in the absence of a nexus of avoidability. This occurs when they fail to prevent the typical results that, in the context of legal assets in their charge, (...) the perpetrator can update their conduct, but refuses to do so without sufficient justification. It is crucial to differentiate between the general clause of equivalence of improper omission and the special clause of equivalence. While the former pertains to all legal assets, the latter is limited to specific legal assets mentioned in Article 25 of the Criminal Code. This distinction is vital to guarantee coherence and proportionality in the application of criminal law, thus preventing potential arbitrariness and violations of fundamental rights while enabling effective protection of positive duties of protection of legal rights with criminal protection. In particular, the issue of extending the position of guarantor to the protection of legal interests beyond those contemplated in the first paragraph of Article 25 of the Criminal Code has been addressed. By means of practical examples and analyses of case law, it has been demonstrated how improper omission can be constituted in a variety of contexts, including situations in which typical behaviors may arise as a result of the negligence or eventual inaction of an individual, whereby the individual in question removes himself from the protection of the legal assets in his control, which he has assumed voluntarily, so that an omission is constituted without sufficient justification. In conclusion, the clarification of the concepts presented here will contribute to the ongoing academic and legal discourse on improper omission in Colombia. It will provide a comprehensive and nuanced understanding of its application and implications within the country's legal framework. Through rigorous and thoughtful analysis, we encourage continued exploration and debate on this complex issue, with the aim of enhancing and strengthening the administration of justice in Colombia. The Epistemological Turn of the Twentieth Century’s Legal Positivism This article analyses the essential changes in the positivist law theory from its modern origins, usually remitted to Hobbes, Bentham and Austin, to the positivism of Kelsen and Hart. It is argued that a crucial epistemological break can be noticed, revealed in the most analytic-rationalistic character of Kelsen and Hart’s elaborations, compared to the more facts-descriptive style of their predecessors. Rationalism in Kelsen and Hart may explain the conventional character of the (...) basic norm and the rule of recognition, validity only formally, and the difficulty of accounting for the formal and substantive components. The change can be associated with Kelsen and Hart’s intellectual context, particularly Hume’s ‘guillotine’, the influences of logical positivism and neo-Kantian schools. This turn should not be overlooked since it casts doubts on the usual speaking of Kelsen and Hart’s legal positivism in the descriptive sense of nineteenth-century philosophers, with relevant consequences for thinking of law. The Shroud of Turin is an old linen fabric imprinted with the image of a tortured man who lies prone with his hands crossed before him. Since for many it is related to Jesus of Nazareth, this cloth is among the most studied, controversial and enigmatic of all archaeological and religious objects. Since its radiocarbon dating at the end of the eighties of the last century, it is considered by many to be an object made in the Middle Ages. The (...) controversy is due to the fact that there are other scientific and artistic evidences that place this object outside the medieval sphere. An argument map is a critical thinking way of representing the relationships between evidences and arguments, and is used here to represent the sequences of argumentation that defend that the Shroud of Turin is not a medieval object. Dado que hoy contamos con la teoría de modelos, una teoría matemática con aplicaciones en lógica, debería ser bastante útil utilizar su marco teórico para comprender el Tractatus. En este trabajo se parte de una lectura interdisciplinar y crítica de los distintos actores y perspectivas que intervienen en la investigación baudelairiana, enfatizando la relación existente entre música y poesía. El conocimiento musical y la pasión por la música de Charles Baudelaire están presentes en su obra, en la que tanto citas directas como alusiones resultan esenciales para el develamiento y la comprensión de su yo poético. No obstante, es en el ámbito de la filosofía donde música y poesía (...) van a encontrarse conciliándose, ya que ambas artes no solo se ven arrastradas naturalmente a la reflexión filosófica, sino que, al igual que la poesía genera “ideas”, la música, por sí misma, compone “ideas-melodías”. El artículo es una aportación al estudio de la antropología política del protohumanismo florentino, centrado en la obra y la figura del maestro de retórica de Dante, el notario Brunetto Latini. Nos ocupamos de exponer la conexión existente entre el desarrollo del gobierno comunal en la península italiana del Duecento y la difusión de una prosa marcadamente pragmática, extendida especialmente entre jueces y notarios, que preconiza la prelacía de la filosofía práctica con respecto a la teoría y la teología. Se (...) toman también en consideración aquellos factores que manifiestan la ruptura del Convivio y de la Commedia de Dante con los supuestos doctrinales de Latini, subrayando la apuesta de Alighieri por una teología poética, que contrasta con la forma de vida inmanente proyectada por la visión enciclopédica del notario, recogida en sus escritos retóricos y políticos. Resumen:El artículo explora la relación entre memoria y tecnología en la obra de Bernard Stiegler, centrando su análisis en la "retención terciaria", una forma de memoria externalizada en artefactos técnicos. La tecnología, más allá de almacenar información, reconfigura los procesos mnemotécnicos e identidad humana, desafiando las distinciones tradicionales entre memoria orgánica y artificial. La era digital transforma cómo recordamos y construimos narrativas personales y colectivas, presentando tanto posibilidades de enriquecimiento cognitivo, como riesgos de erosión de la memoria interna y la (...) identidad cultural.
